HERE IS WHAT TRULLY SADLY HAPPENED ON OCT 28TH, 2016
Mr Jun Wang, nick name Paul, a name he chose from the Bibile, was everyone's brother, uncle, son, nephew. He was born on Feb 13th, 1971 with special talent and superior intelligence, who was Julia's the only little brother. His life was shockingly cut short in the hands of NRPD when he was not criminal but wrongfully treated as criminal and unlawfully killed when he was no danger to anyone with two hands cuffed front and laying on the ground... . He came to US to attend his sister's wedding on Oct 28th, 1995 and shockingly lost his life to police violence at his sister's 21 st wedding anniversary night...
On 10-28-16, Julia Rielinger accompanied by her friend Jon Liptak traveled to the North Royalton Police Department, North Royalton Ohio, to provide them with Cuyahoga County Probate Order regarding the deteriorating mental state of her brother Jun Wang who needed medical treatment. Ms. Rielinger had successfully and without incident previously provided other municipalities the Cuyahoga County Probate Orders to probate her brother and was reasonably familiar with the process. Ms. Rielinger trusted that the North Royalton Police Department that in addition to dispatching officers, would also dispatch an Emergency Medical vehicle and a mobile crisis unit to assist in regard to execute the probate order.
However, upon the arrival of North Royalton Police Officers to her residence to execute the order, Ms. Rielinger observed that there was no EMS vehicle nor Crisis Intervention Team. According to the Transcribed Southwest Dispatch for 10-28-16, radio call number #5441 identified as Patrolman Jason Kimmel contacted radio, canceled the EMS sergeant Billivonich ordered and related that he and #5431 identified as Patrolman Kip McDonald would be enroute to 9859 Independence in connection with a probate order. Radio communication between dispatch #5441, identified as Jason Kimmel captured him stating that the officers (McDonald and Kimmel) would call for an EMS vehicle after their arrival at the Independence address.
However, after their arrival, Julia Rielinger noticed no EMS nor mobile crisis unit on site. She then requested that officers Kimmel and McDonald dispatch EMS and/or a mobile crisis unit before they were allowed to enter the residence. Jon Liptak requested that officers Kimmel and McDonald dispatch additional officers before entering the residence. Prior to executing the Probate Order, Officer Kimmel not only failed to secure dispatch of an EMS vehicle, but also Officer Kimmel canceled EMS Sgt Bilivonich dispatched before Officer Kimmel left NRPD station and after the officers arrived at the independence address, they did not dispatch as Officer Kimmel told the dispatcher at NRPD station to dispatch once he arrived the residence, they denied Julia Rielinger’s request to dispatch EMS and/or a mobile crisis unit. They denied the request from Mr Jon Liptak for more police officers.
Upon the Officer’s arrival but prior to them entering the residence, Julia Rielinger informed Officer Kimmel that she wanted to speak to her brother first before they entered because she and Jon already told Officer Kimmel at NRPD station that her brother did not speak nor understand English, and Jon requested translator at station. Their requests were denied. Instead, they pushed her aside at the door and stormed into the residence. That behavior was an ineffective tactic that violated their training and probate order protocol procedures. Officer Kimmel screamed and yelled at Jun Wang further escalating the situation and creating a dangerous environment for Jun Wang. This provoked Jun Wang to flee upstairs. Officers Kimmel and McDonald hot chase Jun Wang right away was inconsistent with their de-escalation training. The violation of the Probate Order protocol and failure to de-escalate placed the safety of all in the residence at risk. Jun Wang was already in custody when officers fired the second and fatal shot. Julia was in line of fire when the second shot was fired when her little brother was already in custody after first shot 30 second ago and after his two hands were already cuffed front and he was laying on the ground from the first shot.
Within a couple of feet distance between Officer McDonald and Julia, in revenge Officer McDonald shot Julia’s little brother when he was already in custody and right in front of her extreme unexpectedly, that not only is tremendously emotional battery on Julia but also posted imminent threat and life danger on Julia.
Several days after the incident, in their deposition statements to the Cuyahoga County Sheriff’s Office, both officers Kimmel and McDonald stated that they were unaware that Jun Wang had a knife in his possession at the time he ran upstairs. However the probate order mentioned “knife” and when Officers Kimmel and McDonald aggressively and recklessly stormed in Julia’s home without Julia's permission, her brother was eating with one upon their entry into the house, the officers knew or should have known that Jun Wang was having a knife also It is grossly negligent and reckless that Officers Kimmel and McDonald ignored the contents of the probate order, the statements of Julia Rielinger and Jon Liptak at the NRPD station. They also countermanded their supervisor and canceled the EMS, which violated their training and probate order protocol. If Officer Kimmel had not countermanded Sgt. Bilivonich by cancelling the dispatched EMS vehicle, had not stormed into the house screaming and yelling, and allowed a translator or Julia speak with her brother with a Mobile Crisis Unit, Jun Wang would not have been frightened or fled upstairs, let alone fled with a knife he was eating with. If Officer Kimmel had not assaulted the poor sick man, treated him with absolute no respect but battery as criminal when he was not criminal, forced the hand cuff on him and then stepped on his chest with his left leg after he pushed him on the ground, Jun would not have to push Officer Kimmel's left leg away from his chest with his left hand, then the little knife in his left hand he was eating with earlier would not break off and ended up in Kimmel's leg...Officer Kimmel brought on the injury to himself by denying the medical assistance the probate court order for the poor sick man, aggressively invading and assaulting the poor sick man, forcing him to defend himself....he was so brutally killed after he was assaulted and so bullied...
In the training from the Ohio Attorney General, it specifically stated that when the person in a mental health crisis is terrified, the officers must stay back and keep therapeutically space. Both Officer’s Kimmel and McDonald did the complete opposite. They should have employed some de-escalation Tactics derived from their training. When Julia tried to provide the Order to the North Royalton Police Department two days ago, the Officer-In-Charge stressed to her that because it was probate order, they will not use “hand cuffs”. Officer Kimmel went against the training and protocol by forcing handcuffs on Jun Wang. According to statements Officer Kimmel made to the Cuyahoga County Sheriff’s Office, Jun Wang was cooperating and not combative. Again, another instance when Officer Kimmel acted inconsistent with his training by forcibly hand cuffing Jun Wang’s right hand and escalating the situation. According to Dr Gilson autopsy, there was a severe injury inside Jun Wang’s right wrist.
It is negligent that the NRPD and City did not incorporate de-escalating procedures into their policy and training manual. Since 2012, all NRPD officers received de-escalation training from the Ohio Attorney General. in 2014, City of North Royalton is listed one of 36 cities in Ohio who failed to participate CIT trainings.
It is negligent that the City of North Royalton and their Police Department have not equipped every officer with less lethal weapons (taser) and Body Cameras. If the NRPD equipped every officer with less lethal weapons (tasers) an alternative to lethal force could have been used and Jun Wang would still be alive. Officer Kimmel acknowledged that he received and was certified in less lethal training, including Pepper Spray. Both Officers failed to employ any Less Lethal mechanisms on 10-28-16. Officer Kimmel defended himself by saying that the reasons why he did not use pepper spray is because he did not want the chemical of pepper spray got on him. According to Dispatch Recording records no EMS vehicle transported Jun Wang to the Emergency Room until 29 minutes after the second shot was fired. The Officers present on scene as well as the City of North Royalton had responsibility to provide expedient emergency medical treatment to Jun Wang on 10-28-16 but they would rather to take care patrolman Kimmel first who was not in any life danger vs Jun and no EMS took Jun to ER till 30 min later after the second shot was fired.
On July 20th, 2021, after the deposition the Counsel for the City of North Royalton conducted with Julia Rielinger, without Julia Rielinger's Counsels' present, the experts for City of North Royalton reviewed the two bullet fragments removed from Jun Wang. The bullets were erroneously provided to the NRPD from the Cuyahoga County Sheriff and Medical Examiner’s Office
Additionally, on 10-28-16, Julia Rielinger and Jon Liptak were detained by the North Royalton Police Department beyond the scope of time necessary to confirm or dispel whether they were to be arrested or released. That extended period of more than four hours was excessive and violated their constitutional right to be free from unreasonable seizure also violated their training of Laws of Arrest and Search, Seizure/Search Warrants.
Instead of getting medical help for her little brother, Officers Kimmel and McDonald aggressively invaded Julia's peaceful home against her consent, never gave Julia a chance to say "hello' nor "good bye" to his beloved brother but shockingly and brutally killed her beloved little brother right in front of her.. then made lies after lies, NRPD and City of North Royalton have been lack of transparency for years, no apology but years' severe bully on Julia ... her elder brother died from grieving over the police brutality on his little brother and the elder sister was hospitalized for months for the bullies NRPD, City of N Royalton and Traveler Insurance inflicted on Julia...For six years, Traveler Insurance has been making lies after lies trying to help cover up the crimes and help the wrongdoing officers get away. This Traveler Insurance is putting our communities in great danger!
